Japanese Knotweed Excavation and Removal in Residential Property

Our client was the owner of a residential property with very limited access to the rear of the house, which comprised of a decked terrace overlooking a long, narrow garden, which sat several feet lower than the house. There were two infestations of Japanese Knotweed present within the garden. How does it spread?

Each plant can release up to 150,000 windborne seeds per season, with a high germination rate. Seeds can also remain viable in the soil for up to two decades.

Do I have a legal duty to remove ragwort?

Yes, if it’s growing on agricultural land. Ragwort is classified as an injurious weed under the Weeds Act 1959. Landowners have a duty of care to prevent it from spreading, especially where it could pose a risk to horses, cattle, or other livestock.
